Hi Guys:
I need to know what laws there are in Texas concerning the purchase of handguns.
Is there a waiting or grace period?
Are gunshops allowed to be open all night?
I won an on-line auction for a handgun out of Austin, TX. The auction ended at midnight last night. I already have an e-mail from this guy at 7:00AM this morning telling me that one of his employees sold the gun "this morning" by accident.
I smell a rat, but wanted to get some of my facts straight before I deal with this fellow.

This doesn't seem right but a link to a summary of Texas firearms is listed below... Pretty much any "waiting period" is the time it takes to get on the phone for the background check... about two minutes.
I've noticed this a lot on the auction sites of late. The note that the firearm is in their shop and for sale. They have some disclaimer about their responsibility, or lack of it, if it is sold. Any of that on this purchase?

I'm not aware of any gunshops in the Austin TX area that are open all night. Chances are, it was subject to prior sale, whether that was clearly documented in the auction listing or not. Probably gone several days ago, not just the morning of the auction. With a Texas CHL, it's a matter of how fast you can fill out the yellow sheet, and even the quick phone call isn't required, although that hardly delays anything significantly, in most cases.
Other than the chain sporting good stores, I'm not even aware of any open before 9:00am, and some don't open until 10:00am. However - pawnshops are another story, I don't think of them as gunshops but of course a great many of them have FFLs and deal in firearms. No idea what their hours are.
The person who listed it probably forgot about cancelling the auction until they got an email from the auction site - oops!
If the auction was not clearly marked as such, I think I'd complain to the auction site.

At least the gunshop I frequent takes the guns and puts them in the back if they are on the internet. I tried to look at more than one gun but they were on the internet so he wouldn't even let me see them. Once he sells them though, he'll bring up to the front to get them ready for shipping and thats when I get to see them :)

Sure hope you he didn't get your money! I suggest you file a complaint with the auction site and post a negative review if that is possible.

Update:
The gun dealer has offered to sell me another pistol of the same make/model/style etc. for the same price.
No harm no foul. I'm easy to get along with.
