City of New Orleans, Mayor Ray Nagin
Once Again Found in Contempt of Court
District Court Judge to City Attorney:
Conduct "wholly unprofessional"
Fairfax, VA-The National Rifle Association (NRA) and law abiding gun owners have won yet another victory this morning against New Orleans Mayor Ray Nagin and former police chief Warren Riley.
Judge Carl J. Barbier, presiding over the U.S. District Court for the Eastern District of Louisiana, granted NRA's motion for contempt against New Orleans Mayor Ray Nagin and Warren Riley for "failure to provide initial disclosures and to compel answers to discovery" during NRA's injunction against the City for their illegal gun confiscation of law abiding citizens following Hurricane Katrina in 2006.
"Once more, Mayor Ray Nagin and former police chief Warren Riley are held accountable for considering themselves above the law," said Chris W. Cox, NRA's chief lobbyist. "These men have had to be dragged, kicking and screaming, every step of the way in this process to return the lawfully owned firearms to their own citizens, and Judge Barbier rightly found them in contempt of court for their complete lack of respect for the rule of law."
Furthermore, Judge Barbier concluded the delaying tactics by the City's attorney, Joseph Vincent DiRosa, Jr, to be "wholly unprofessional and shall not be condoned". Mr. DiRosa admitted in Court that he had "no good reason" to explain his actions and has been ordered to pay partial legal fees to NRA's attorneys for their wasted time and money.
"Ray Nagin, Warren Riley and their attorney refused to provide vital information to the U.S. District Court for their unconstitutional acts in their city's time of great need," concluded Cox. "On behalf of the lawful gun owners of New Orleans, NRA is pleased with this outcome, we thank Judge Barbier for his swift decision and we will continue to press for the full return of all the city's confiscated firearms."

I agree about Rays lack of tact and guise. Now the world can see the true face of liberalism and what they think of our Constitution and Bill of Rights. I guess "Chocolate City " will be gunless except for the corupt police and the always present criminals. Hard Cast

He could come to NY and fit right in with Hillary as a liberal gun-grabbing carpetbagger...
Might even get to run for President some day ike liberal gun-banning mayor Giuliani.

I am a little relieved. When I first read the thread title, I was aware of tornado's in the area. My thoughts were "Oh ####, Not again! ?"
It is good that the decision went the way that it did! "Article II" of the "Amedments to the Constitution of the United States of America" must have played a big part of that decision?
What is the penalty for violating the costitiution? Tar and feathers? Buy your own lunch?
Time for sleep.

Boiled down to two guns...Ray and Mitch...Mitch is proably a bigger smuck. Then again, that's my neighbor's mayor now, I'm out of that parish.
But isn't that really our system 99% of the time...Putz vs. Smuck?

IT AIN'T over till it's over. I'd almost bet that the folks don't get their guns back and the two smucks don't pay much.
After all, that's our system!

Yall be careful when using words like chocolate city, I got banned from one site for less than that! But everything you say is true. The Brady Bunch will likely jump on the band wagon just for publicity! Glenn

Yupp! I have been "awed" by that. "What a guy"?
We need to get them guns back to the folks that were "wronged" after Katrina. "Some", in government, exceded thier authority at at a "federal level". They should be "held accountable" for thier actions, just like you and me would be?

And/or .... lifetime appointment to the Supreme Court or run for president. Recall the McCain-Feingold Act.

Ok, I am not a legal scholar. However, Ray Nagin and company are found in contempt. They are are required to return or compensate those affected or What? At what point do they get forceably thrown into prison for breaking the law. I would assume under our constitiution that no one is above the law, yet these guys still walk the street and are still ruling over an American City. Could someone with a law degree please explain the process here. Or, is this like so many other cases where city officials run amuck where a fine is imposed which is just passed onto the tax payers?
Hard to say justice is being served and our right to bear arms is intact when the parties in contempt of court are not behind bars or that the gun owners have received thier guns back. I dont see this as much of a win right now, too many delays.
Maybe I am just losing patience :(

Sadly kdub, those with more money are more equal than those of us without a fat bank account.
So far I may be with Cheezy on that one too. Let's see how you do in focus groups and at teh debates! :D
Oh, no you don't!
Used to be a Zone Planning Commissioner, a City Councilman and finally Mayor, back in Okieland. Found politics ain't my bag - went from a moving target to a sitting one! :D

kdub, don't worry about national politics, remember you're a gun guy, they don't want anyone to run for office who doesn't have to fake a hunting picture like Kerry did! And by the way thanks for letting this topic run it's coarse. Glenn

Well Guys, I did not expect this to turn into a political tirade, but I can certainly see why it headed off in that tangent. I thought you all would be glad to know the court sees this one "our" way.
