Sturm Ruger Rifle Has No Design Defects, Jury Finds
Tuesday October 7, 4:40 pm ET
SOUTHPORT, Conn. (Dow Jones)--Sturm Ruger & Co.'s rifle design was found to reasonably safe and free from defects by an Alaska jury.
The case, Whaley v. Sturm Ruger & Co. (NYSE:RGR - News), involved a hunter who suffered a gunshot wound to his hand, which was placed over the muzzle of a loaded Ruger M77 rifle while he was cleaning the trigger area with the safety off.
In a press release Tuesday, the gunmaker said the verdict continues its 30- year record of winning product liability cases. The company attributed its record to its ongoing product safety measures.
Four product liability suits are currently pending against the company, the lowest since product liability cases began in the 1970s, Sturm Ruger said.
Sturm Ruger and other firearm makers have faced a spate of lawsuits in recent years alleging that the companies sell unsafe products and create a public nuisance. Many of these suits in various cities and counties across the country have been dismissed.
In June, the New York State Supreme Court, Appellate Division, affirmed the dismissal of claims made by New York State Attorney General Eliot Spitzer that Sturm Ruger & Co. and other firearms makers were liable for the public costs of urban gun violence. Spitzer's lawsuit wanted to force the firearms industry to make handguns with more elaborate safety guards, to place tighter control on retail gun sales and to keep guns from criminal and juvenile users.
